Qualified Account Disclosure Reminders & Tips

• When is an investment analysis required?  An investment analysis is required for all rollovers or transfers of qualified funds.  This also includes all subsequent transactions for existing accounts.  Two rollovers required two investment analysis.Whenever you complete an investment analysis and save in the client file, remember to check the Investment Analysis box and Saved in Client File box on the OSJ Disclosure Checklist, otherwise note on the Routing Slip or attach a copy for documentation.  Remember to check the boxes on the disclosure checklist when using an approved IPS (Investment Policy Statement) that meets the DOL requirements.

• Is a BIA (Best Interest Analysis) required for subsequent qualified account rollovers or transfers?  Yes, a BIA is required for each rollover or transfer.  If you have more than one rollover or transfer transaction being submitted, please reference in the Notes section the corresponding transaction.Following these compliance guidelines will reduce the need for us to pend a trade key back for confirmation.

Other Reminders

• Resubmission of Dated Material:As previously announced, we are approaching the March 2024 deadline to submit material previously approved in CLIC® AdView prior to January 1, 2022, that is still in use to the new system in RegEd AdTrax.Historical submissions in AdView prior to the January 1, 2022 date were not imported and must be resubmitted before March 15, 2024, if you wish to continue using them. Following March 15, 2024, AdView will be decommissioned. Anything not resubmitted at that point will be considered expired and no longer approved for use.

• New Form CRS Website Requirement:Recent guidance from the SEC has outlined the necessity to include a link to Form CRS (Customer Relationship Summary) on all websites which advertise services of the Broker/Dealer (B/D) or Registered Investment Adviser (RIA).Below is a pre-approved link that you can add to your website footer to meet this requirement. If using the link below exactly as written you do not need to submit for Advertising Compliance approval.
